Terms and conditions for Breast Pump Rental (Medela Symphony) - 1 Month
This Agreement for the rental of a Medela Product and Carrying Case (“equipment”) is made between Then Comes Baby, LLC and the Lessee identified through the account created to rent this pump.
1. The equipment remains the property of Medela, Inc. McHenry, IL. Lessee has no rights to such equipment except as expressed in this Agreement
2. Lessee may purchase an accessory kit separately. The kit becomes property of the Lessee.
3. Lessee agrees to pay the rental fees in accordance with the fee structure established shown under the rental payment plans. The rental fee is due in advance.
4. The rental rates for the equipment and the purchase price for the kit do not include any applicable sales or use tax. Alameda County Sales Taxes are currently 9.5% and are applicable for pump rentals and all retail purchases.
5. Lessee shall leave a security deposit with Then Comes Baby, LLC of $250. This security deposit will be returned in full when the breast pump is returned on time and in good condition.
6. Lessee agrees to inform the Rental Station of any change of address, phone, email address, and credit card changes.
7. Lessee agrees not to move the equipment out of this State without the consent of Then Comes Baby, LLC.
8. Lessee agrees to allow no person other than Lessee to use the equipment provided.
9. Lessee agrees to return the equipment in clean condition. If the equipment is not clean, Lessee agrees to pay Then Comes Baby, LLC a minimum cleaning fee of $15.
10. Lessee agrees to return the equipment in good repair. If the equipment is not in good repair, Lessee agrees to pay Then Comes Baby, LLC a minimum charge of $50.
11. This Agreement shall be construed under the laws of the State of California.
12. Should we not hear from you toward the end of your rental period, we will make reasonable attempts to contact you via phone, email, or and/ or text message. If we do not hear back from you within 3 days of your rental due date, your credit card will be charged for another month’s rental and we will notify you by email of your new breast pump due date.. If we do not hear back from you at the end of that month, we reserve the right to retain the $250 deposit and we will send you a certified letter to initiate the collection process. The Lessee shall be responsible for all reasonable legal fees and other costs involved in collection of overdue amounts and/ or recovery of equipment.
13. Then Comes Baby, LLC has the right to cancel this agreement at any time with three days notice.
14. Lessee agrees to allow Then Comes Baby, LLC, Medela Inc or any agency involved in collection of overdue amounts and/ or equipment to obtain a credit report on Lessee.
MEDELA, INC WARRANTS TO REPAIR OR REPLACE ANY EQUIPMENT WHICH IS OR BECOMES DEFECTIVE UNDER NORMAL USE. THEN COMES BABY, LLC AND MEDELA INC WILL NOT BE LIABLE FOR INCIDENTAL, CONSEQUENTIAL OR ANY OTHER DAMAGES RESULTING FROM DEFECTIVE EQUIPMENT; THEIR LIABILITY IS LIMITED TO REPAIR OR REPLACEMENT OF THE EQUIPMENT. THIS WARRANTY IS GIVEN IN LIEU OF ALL OTHER WARRANTIES EXPRESSED OR IMPLIED.
